The papers relate to the Manors of Clothy Hopkin, Urishay, Trenant and Wellbrook which lay to the north east of Ewyas Lacy in the Peterchurch area. Each of the Manors exhibit numerous variations as to spelling. Three were held from the Manor of Snodhill but the Manor of Clothy Hopkin, which lay within Ewyas Lacy, in the parish of Michaelchurch Escley, was held directly from the Hopton moiety of the Ewyas Lacy Manor.
They recite, in particular, minutes of Court Baron, Court Leet and Frankpledge meetings dating primarily from 1705 to 1743 and 1810 to 1833 but not including all years. There are also entries for Wilbrook for 1466, 1525, 1537 and 1539, and 1671 for the other Manors.
The subject matter includes the general notices and proceedings of the Courts and lists of chief rents, lease rents, tenant’s names and juror’s names as well as a number of miscellaneous matters.

Present that John Watkins of Michaelchurch a tenant of Clothy Hopkins holds lands in Michaelchurch in the manor of Clothy under a lease from the Lord for 500d yrs at 3/4 a year payable payable sic. yearly at Christmas & he is in arrear 30s for 9 yrs rent – fine 39s if he does not pay with[in] 30 days after notice.
1738 The death of John Watkins presented & that he held several messuages etc. part whereof was held by lease under the lord & d. part freehold, but what heriot or d. benefit accrued to the Lord the jury could not state but refered to the title deed.

Bailiff of the said manor.
Mannor of
At a court of Survey and Court Baron of [blank] held for the said mannor on the [blank] day of [blank] in the seventh year of the reign of our sovereign lord George the second King of Great Britain France and Ireland Defender of the faith and so forth before Edward Williams gentleman steward of the said mannor as well by the oath of the jury whose names are underwritten as by the inspection and examination of the ancient court rolls and other evidences belonging to the said mannor.

First what are the several limits butts and bounds of the said mannor what franchises liberties or priviledges belong to the same And whether any person or persons whatsoever have intruded or incroached upon the said mannor or any of the franchises liberties and priviledges belonging thereto.
2. Also do you of any lands tenements rents duties services or other profits, books, court rolls or other writings belonging to the said mannor that are concealed or detained from the lord of this mannor, how long since, by whom what is so concealed or detained and the value thereof.
3. Also what mountains heaths wastes or commons are within the said mannor, appertaining or belonging to the lord of the said mannor, what incroachments thereon, by whom how long contained and what rents & services have been paid to the lord or lords of the said mannor for the same what rights of common or other priviledges the tenants of the said mannor have in the said wastes or commons what is due or payable to the lord of the said mannor for the same To whom do the quarries of stone or mines of coal or any minerals whatsoever (if any be found) mosses of peate or turf on the said wastes or commons belong unto. What timber trees or other trees have been cut or fallen upon the said wasts or commons by whom how long since and to what value.
Also what are the customs in generall of the said mannor What fines reliefs issues amercements perquisites of court herriotts wayfes estrays felons goods treasuretrove deodans and other casualties duties or profits happening within the said mannor are due and belonging to the lord of the said mannor And what is the custom of the said mannor touching the payment thereof.
Also what are the butts and bounds between the freehold land and leasehold land belonging to the said lord within the said mannor Whether any tenant or person whatsoever have plowed up cast down removed or taken away any mear stone baulk hedgerow or landshare between the said mannor and other mannors or lordships thereto adjoining or between the lords land or any other lands or tenements or between any the freehold or leasehold lands in the said mannor. By whom was such offence committed and where and where and in what place ought those altered bounds to stand and remain?
Also whether any wast hath been committed or suffered by any of the freeholders leaseholders or tenants at will within the said mannor upon any of the lands or tenements the hold of the said lord either in pulling down of houses, buildings, walls pales or fences or by suffering of them to go into decay for want of repairation or by cutting or destroying of timber trees or fruit trees or by plowing up of antient meadow or pasture ground or the like By whom hath the said wast been committed or suffered how lolng since and what damage hath it been or is it now to the said lord.
7. Also whether any tenant within the said lordship have severed, aliened, divided or dismembered any lands or tenements held of or belonging to the lord of this mannor what lands are so aliened to whom in whose possession are the said lands now And what rents or services are due to lord of the said mannor for the same.
8. Also what and how many hamlets and townships are within the said mannor What mannors messuages lands and tenements are held of the same by what tenures rents and services are the same held what interest terms of lifes or years the freeholders or leaseholders within the said mannor have in their freehods or leases.
We present all the cottagers upon the lords waste to be in the lords mercy for their cottages & inclosures etc.
Item we present that if any tenant or commoner having liberty of common shall take any cattle of any person or persons that have noe right of common within this liberty pretendinge the same to be his or their owne such tenant or commoner shall be deemed a trespasser and shall pay the rates followinge vizt [p] quarter for every horned beaste under two years old 4s for every horned beaste above two years old 6 for every horse or colt 10s for every sheep 1 And soe for any longer or shorter tyme after the foresaid rate.
Item we present that if any tenant or commoner holds more lands then that which payes rent and service to the lord of this manner and shall turne into the common sheep or catle from those lands which he holds and that he hath noe right soe to doe that such person shall be deemed a recluser and shall pay for his overplus stock the rates aforesaid as a trespasser.
Item we present that if any person or persons driveinge sheep or cattle to fair or market and soe bringe them to the said common bearinge them there to depasture that it shall be lawfull for the bailiff of the maner to impound and detaine such cattle until reasonable satisfaccion be made for the trespass.
Item we present that the bailiff of this maner shall take diligent care and give a true account conferminge the premises unto the lord and tenants not offendinge in any parte thereof on or before the 24th of June next that the rates and penaltyes aforesaid may be charged upon the offenders And the one halfe paid to the lord of the maner & the other halfe to the tenants both allowinge thereout reasonable satisfaccion to the baillyff for his diligence and care therein.
Item we present that if any tenant or commoner offendinge in the points aforesaid and shall endeavour to conseale and deny to give a true account when thereunto caled that such offender deniinge or consealinge shall over and above the rates aforesaid forfeit the summe of 5s to be accounted as aforesaid and returned by the bailiffe to the lord of this maner.
Humphrey Thomas esq holds an estate in Trilers Hope within the maner of Trilers Hope and jurisdiction of John Delahay esq payinge yearly to the said John Delahay the summe or rent of 8s & two feasts in the yeare that is to say at Michaellmas and lady day.
The said Humphrey Thomas hold certaine other lands called Lloyne On within the maner of Clothye Hopkin at the yearly rent or summe of 6d to be payd as aforesaid.
William Watkin holds a messuage holds a messuage and certain land in Trileis Hope aforesaid at the yearly rent or summe of 12s to be payd as aforesaid.
John Price gent holds land with a decayd toft or former buildings falled or demolished within the maner of Clothye Hopkin at the yearly rent or summe of 1s 6d to be payd as aforesaid.
Mary Lewis widow holds certain lands and a messuage within the said maner of Clothye Hopkin at the yearly rent or summe of 5s to be payd in maner aforesaid.
Mrs Parry the late wife of John Watkins deceased holds certain lands within the maner of Clothye aforesaid at the yearly rent or summe of 3s 4d to be yearly paid as aforesaid.
Thomas Smith holds certain lands within the said manner of Clothye Hopkin scittuate lyinge and being within the parish of Michaell Church Eskley containinge by estimacion 16ne [ac?] acres at the yearly rent of – 8.
Item the said Thomas Smith holds one messuage or tenement lyinge within the maner of Urishay called Rode Monten at the yearly rent of 3s - 10d .
Item the said Thomas Smith holds one messuage [ ] and certaine lands meadows and pasture lyinge within the maner of Urishay at the yearly rent of 5s -4d .
Elizabeth Morgan widow the late wife of Reece Morgan deceased holds one messuage or tenement with certaine lands within the said manner of Clothiey Hopkin at the yearly rent of 1s -10d .
Item William Watkins holds the messuage and certaine lands erable meadow pasture and wood grownds in Tryeies Hope heretofore granted by the said Thomas Ury Delahay and Richard hid son & Richard David at the yearly rent of twelve shillings suite of court and [a] heriot at the decease of every tenent dyeinge [?seized] thereof vizt. the second best beast and one co[uple] of capons at Christmas yearly.

Item Thomas Prichard and Katherine his mother holds two messages and certaine lands meadows pasture and wood heretofore granted by the said Thomas Ury Delahay and Richard his son to Howell David John at the yearly rent of seven shillings and ten pence suit of courte a heriot for each messuage upon the decease of every tenente dyeing seized thereof the second beast and two couple of capons at Christmas yearly.
Item Richard Greenow [holds] one messuage or tenement and certaine lands [meadow] and pasture heretofore granted by the said Thomas Ury Delahay and Richard his son at the yearly rent of four shillings suite of court and one heriot at the decease of every tenant dyeinge seized thereof and one couple of capons at Christmas yearly.

Item James Gilbert holds one messuage and certaine lands meadows and pasture being parte of the land heretofore granted by the said Thomas Ury Delahay and Richard his son to Watkin Thomas Morgan and now in the tenure and occupaccion of the said James Gilbert or hiss tenants or assignes payinge yearly the rent or sume of eight pence by equal porccions suite of courte a heriot at the decease of every tenant dyeinge seized thereof and one couple of capons at Christmas yearly.

Gentlemen of the jury.
You are here assembled to execute as great a trust as can be [reporid?] in any men living which is the jurisdiction of the lord of this Leet over the resiants & inhabitants of this manor. This & all other courts leet are of a very antient institution & where first founded at the time the Saxons inhabited this island. For at that period of time this Kind [ors?] was divided into many different districts [&?] inhabitants each district having a king of their own who held a court of judicature in which he himself presided as judge & tried & determined all offences from the highest to lowest the reign of her king did not continue many ages before the flame of war was kindled and almost a quite all then different governments monarchs engaged in a war against each other. But at length the constitution of [?vorne] of a governments being in each impaired by a long & tedious war they [? ew] to some of their neighbours with whom they were with peace & implored their aid and assistance by which means many of the states became very powerful & their dominions became very extensive And that period it found practicable for the king who [?stile] [?that] a supreme judge to try & determine [ erorns?] [?t]he offences than happened within the jurisdiction of this dominion at which it was thought [?adoriable that grants should be made to the most powerful persons within the king’s territories enabling to hold a court Leet & to try & determine offences from the highest to the lowest From that time courts leet were made universal [? t] the kingdom growing more populous & offences still increasing & found necessary to institute [? ] courts of justice to try offences recover debts for which part [on?] the [?affired] general quarter [ ] over this kingdom which continue to this day. And [?Decot] [?alkto] there at not instituted into [?eac] the [?doods] of Leet who were not able to transact the business of their courts many trespases tried at these courts now as were in those days yet the jurisdictions of the court still subsists & possessed with all the priviledges it then enjoyed And a Presentment made by the jury at this court as of same nature & force or an indictment found by the grand jury at the assize or quarter sessions for the presentments being transferred by the steward of the court to the judge at the assize or the justices at the sessions in sufficient to put the party upon [?linishial] the business which is at this period transacted at this court & which it is your duty to inquire particularly into is treason trespass murder burglary robbery & housburning. If any of you have heard any man speak treason against the king or government that would which to seize assassinate the king’s person or that threated to seize the [?tower] and bring in another monarch or know or have heard of any treasonable correspondence carried on against the king or government by any of his subjects to ought to present it in order that the offenders may be seized & brought to justice If there has been any murder trespass burglary robbery or housburning happened within this manor since the last court you ought to oresent them in order that the offenders may be put upon trial for such offences. The jurisdiction of this court does not [?pretend] to statute laws but to custom only except particularly authorised so to do by the statutes themselves. There are two statutes which the lords of leets or their stewards as particularly directed to give in charge to the jury the is statute made & passed in the reign of K [?] [7t ] called the riot act & is indent to prevent riots & unlawful assemblys in which it is enacted that if any persons above the number [? ] assemble together & do not disperse within 1 hour after this act [ ed] it is death by the law the othe is an act made and passed in the year of the reign of his late majesty K [G?] 2nd and is called the [?b]lack act and by this act it is enacted that if any person or persons [ to ] accused in a disguise by having their face blacked or being other disfigured as not to be known this is also Death by the Law. Any [?is] instance of kind has happened since the holding of the last court is a duty to present it as a Capital offence in order that the person so ooffending might be brought to justice.

These are to require you upon sight hereof to give warning & notice to all freeholders & resiants within the precincts of this mannor of the court Leete & Court Baron for the said mannor wilbe held at the dwelling house of Evan Jones at the Urishay Common inholder Saturday the 24th day of this instatnt October where all tenants free [?tutors] & resiants within the precincts of the Leete there are required to make their personal appearance & to doe & perform such suite & service as by their respective tenures they ow to their said [?courts] Giving them (To witt) That is they or either of them make default they shalbe severally amerced & you are required to be then & there present to make return of this [?qor] [?prepts] Given under my hand & seal the 17th day of October Annoque domini 1730.

Whereas John Delahay esquire lord of the manor of Urishay Clothye Hopkin and Trileis Hope alias Trenant lately deceased did give devise and bequeath the said manor with their appurtenances unto his couzen Thomas Delahay of Welbrooke gentleman first and nearest relation to continue the name of Delahay. This is therefore to certifie you that the said Thomas Delahay have caused a court of view of franck pledge and enquiry to be made within the said mannor concernnge the due observaccion of the king’s peace and other things relatinge to the said courte in manner as heretofore tyme out of minde the same hath been kept And that it was held the nineteenth day of this instant April Anno domini 1726 at the place where the same is usually kept within the mannor of Clothye Hopkin where the tenants appeared a jurry sworn and the charge given.

Greeting.
These are in his majestie’s name to will and require you forthwith to give due and lawful summons to all and singular the inhabitants tenants and resiants within the said mannors, that they and every of them be and personally appear before me at the dwelling house of Evan Jones in the parish of Michaelchurch within the said mannour upon Wenesday the third day of October next by ten of the clock in the morning at the court Leet of our sovereign lord the king and view of frank pledge and also the court baron of Magdalen Delahay widow Lady of the said mannour then and there to do their suit And you are hereby likewise required to give due and lawful summons to twenty four able freeholders that are tenants within the said mannour that they and every of them be and personally appear before me at the time and place aforesaid at the said court to be sworn and impannelled to enquire for our sovereign lord the king and the lady of the said mannour of all such matters and things as shall be given them in charges and have you then and there the names of the said inhabitants and tenants and resiants jurors and this precept Given under my hand and seal the twenty ninth day of August in the year of our Lord 1738.

Dear Sir Peterchurch, June 15, 1810
Your clerk Mr Rogers came yesterday and made a copy of my will, he also broght the agreements between me and my tenants which could not be completed as your last letter was delayed at the Oak. Therefore could not inform my tenants of the day your clerk was to come over in order for them to give him the meeting. I find Mr Jacob Holland have promised to let me have the money by the time I did mention. I certainly did not interfere, but as I informed you before a gentleman of the name of Rogers came to my house and informed me that the Oak Timber which I sold to Mr Jacob Holland he had turned over to him and his company and that they should pay me all the money which was due. Provided Mr Holland’s property was sufficient for double the sum due to me, this I must say that a man so far advanced in years and so infirm as Mr Holland cannot be deemed so proper a person to transact business as three much younger men and at his time of life there is a hazard of his droping off before the appointed times for the payment of the money. However i do not deserve to prevent Mr Holland from any advantage he may have with these men in his bargainwith them. I and my sister gave your clerk instructions for you to make another will for my sister and brought down her old will which was made by Mr Downes some years since in order to mention to your clerk the particulars in it which she did approve to have in the former will and by some meants mislaid it or whether my brothers son John found it dropt out of my pocket and pickd it up as he was in the house in that will she had left all her property to me only a sum of money yearly to my brother’s daughter for her life and other legacys her intention is to leave it in the same way as I did, But I believe I did not mention that it tis her desire that it should be first left to me and afterwards to Mr Morgan Reese and his family. I apprehend the old will is not any consequence after the new will is made therefore desire new will get it finished as soon as convenient. I am dear sir your obliged humble servant.

Imprimis We the jurors sworn and impannelled to enquire for our sovereign lord the king & the lord of the mannor Do Present as followeth.
We present that Thomas Griffiths of the Cwmb in the parish of Peterchurch tenant of this mannor who owes suit & service to this court & hath been duly summoned to appear at this court as appears by the oath of the baylief of this mannor That he hath made default & for such his default we amerce him in the sum of three shillings & four pence.
And the same was afterwards affeared at eighteen pence.
Also We present the said Thomas Griffiths for neglected and refusing to set up a gate & amend his hedge between a certain parcel of land in possession of the said Thomas Griffiths called Cae Mawr & a parcel of land of Mr John Price’s of Urishay called Errow Glideer all in the said mannor of Urishay by means whereof the said John Price has had several trespassers done in his hand in the said mannor & we lay a penalty of 13s 4d to be levied upon the said Thomas Griffith’s goods & chattels in case he neglects to set up the said gate or repair the said fence on or before the second day of February next. And that the said John Price do certify the performance thereof on like penalty.
Also We lay the said Thomas Griffith under the same penalty if he does not repair the fence between the parcel of land in the possesson of said Thomas Griffiths called Wern Willim’s meadow and a piece of land called Dinol in possession of Richard Gronow in the mannor aforesaid on or before the said 2nd day of February next. And that the said Richard Gronow do certify the repair the repair the roof under the said penalty of 13s 4d .
Also We present that John Watkins late of Michael Church Escly gent a tenant of the mannor of Clothie Hopkin holds certain lands in Michaelchurch aforesaid in the said mannor of Clothie Hopkin by lease for five hundred years under said lord of this mannor at this court of three shillings &four pence payable yearly at Christmas. And that he is in arrear the sum of thirty shillings for nine years rent [?reserved] by the said lease due and in arrear since Christmas last And we lay him under the penalty of thirty nine shillings to be levied on his goods and chattels, in case he neglects to pay the same within the space of thirty days next after notice hereof.

We the jurors aforesaid impannelled to enquire on behalf of our sovereign lord & king and the lord of the said mannors Do upon our several oaths present.
That John Watkins gentleman who owed suit and service to this court died since the last court possessed of several messuages or tenements and lands within this mannor part whereof is held by lease and o[f] the lord of this mannor for a term of 500 years and other part thereof freehold. But what heriot or other benefit happens to the said lord we know not, but refer our selves to the deeds & former court rolls.
We present that an incroachment has been lately made by some of the tenants to Henry Jenkins land of part of the common of Urishay at a place called Hewl Moch Deon and inclosed into a parcel of land of the said Henry Jenkins now in the occupation of Peter Powell called Cae Monneth containing in length about 60 yards and in breadth 5 or six yards with several trees growing in the said incroachment which now growing on the said common [ ] we [?lay] the said Peter Powell and or a penalty of xxxxs that to [?his] the same open before Lady day next and that Mr John Price and James Smith do certify under like penalty.

These are in his majesties name to will & require you forthwith to give due and lawful summons to all and singular the inhabitants tenants & resiants within the said mannors that they and every of them be personally appear before me at the usual place of court keeping within the said mannors on Tuesday the eighteenth day of this instant October by ten of the clock in the forenoon of the same day at the court Leet of our sovereign lord the king & view of frank pledge. And also the court baron of John Delahay esq. lord of the said mannors then & there to do suit. And you are likewise required to give due and lawful summons to twenty four able freeholders that are tenants within the said mannors that they and every of them be & personally appear before me at the same place aforesaid, at the said court to be sworn & impannelled to enquire for our sovereign lord the king & the lord of the said mannors of all suc matters and things as shall be given them in charge, and have you then & there the names of the said inhabitants yenants resiants jurors & this precept. Item That Timothy Price son of Thomas John & one of the tenants of the same mannor died likewise possessed of a mess. & tenement within the same mannor since the last court & that a heriot of the second best beast accrued to the lord by his death which we likewise find is paid to the lord.

Notice is hereby given that a court Leet of our Sovereign Lord the king and view of Frank pledge and also the Court Baron of Thomas Delahay Esquire the lord of the said mannor will be holden at the dwelling house of the said Thomas Delahay called The Urishay Castle within the mannor of Clothy Hopkin aforesaid on Monday the second day of December next at twelve o’clock at noon when and where the Freeholders, tenants inhabitants and residents within the said manors are requested to do suit and service and to perform such other duties as may lawfully be enjoined them. [At?] the same court came Anne Symonds widow late wife of Jacob Symonds deceased of Trelishope and [b]rought into court [a cer]teyne writeing wherein is mencioned that the [ ] by his last will and testament bearing date the vj th day of March 1667 did give and deviseunto the said Anne during her widowhood his then dwelling house together with the garden one orchard and curtilage with the appurtenances in Trilleshope aforesaid (excepting the chamber where Elizabeth his sister did inhabit.
Item Thomas Smith one of the jury aforesaid acknowledged to hold of the lord within the manor one messuage and certeyne lands meadowe and pasture with the appurtenances called Rede Monnten in Urishay aforesaid And one other messuage or tenement and certen lands meadowe & pasture called Oldhay heretofore purchased by Thomas ap Thomas of Thomas and Richard Delahay gent deceased by rent by yeare ijs viij d a coaple of capons and for the premises called Oldehay one herriott vizt. the second best beast after the death of every tenant And for the said messuage & premises called Rede Mounten five shillings in the name of a herriott after the death of every tenante.
Item Thomas Prichard one of the jury aforesaid acknowledged to hopuld of the lord within this manor two messuages the one called Teere Croyne and the other called Bromyhake and certayne lands meadowe and pasture freehould heretofore purchased by Howell David John by rent by yeare vjs a coople of capons and two herriotts vizt. the two second best beasts after the death of every tenant.
Item Thomas Parry one of the jury aforesaid acknowledged to hold of the lord of this manor one messuage or tenement and certeyne lands meadowe & pasture called Rede Mounten freehold heretofore purchased by Thomas William Parry deceased of Thomas and Richard Delahay gent. by rent by yeare xxd a coople of capons and five shillings in the name of a herriott after the death of every tenante.
Item they present that James Gilbert in the right of Mary his wife daughter of Richard Powell deceased holdeth within this manor eight acres of arable land meadow & pasture more or lesse lately called Coome Croyne for the the sic. tearme of ninety nyne yeares by the demise of John Powell and Thomas Powell his sonne by lease dated the ix th day of October 1632 thereof made unto Richard Powell and Jane his wife nowe both deceased.
Item John Watkins acknowledged to hould of the lord within this manor one messuage together with one parcel of land called Holdhay alias Oldhay within the fee of Urishay aforesaid by rent by yeare xxd suite of courte and a herriott vizt. the second best beast after the death of every tenant.
Item Richard Griffith one of the jury aforesaid acknowledged to hold of the lordof this manor one meadowe called Gworlod Vayne and the third part of one messuage freehold late in the tenure of Anne Griffith his mother deceased by rent by year viijd suite of courte and coo ple of capons every second year and a herriott after the death of every tenante.
Item LysonWatkine one of the jury aforesaid acknowledged to hould that the lord one messuage or tenement and thirty acres of land pasture & wood lyeing in Trilleshope aforesaid called Gotterelle land and one parcel of meadowe called the Moore seven acres there called the Heldes and fower acres there called the oarles by rent by yeare vjs viijd a coople of capons and one herriott vizt. the second best beast after the death of every tenante heretofore purchased by Richard David of Thomas & Richard Delahay.
Item Johan Watkine widdowe acknowledges to hold of the lord within this manor one parcel of land and the third parte of a messuage freehold parcel of the messuage and lands late of Howell WWatkine her father deceased by rent by yeare viijd a ccople of capons every second yeare suite of courte and a herriott after the death of every tenante.
Item Perine James widdowe acknowledged to hould of the lord within this manor one messuage or tenement and cereyne lands meadowe and pasture called Shelleys land freehold by rent by yeare iijs two capons suite of courte and a herriott vizt. the second best beast after the death of every tenante.

Imprimis We the said jurors say and present that all persons that were duly and lawfully summond to appear at this court and thereof have made default are i the lords mercy yenants 3s ressiants 1s per caputt.
Item We present all the cottagers and incroachers now in beinge on the lords waste to be and that they are in the lords mercy.
Item We present Thomas Maddox for keepeinge a couple of goates and we doe amerse the said Thomas Maddox for the same in six shillings and eight pence unless the said goates be putt off between this and the next leete to be holden for this said manor.
Item We present the highway commonly called by the name of Hewl y Moch Dyon to be out of repair and that it ought to be repaired by the Brinkers from the Urishay common to the end of the High Way which lead upp from Coed Poeth towards the Hay And we doe amerce each Brinker in 3s 4d unless it be repaired between this day and next Michaellmas Leet to be holden for this said maner.
Item We present Richard Grunow for depasturinge cattle etc. upon the Urishay common having transferred his right of common in the said common to his tenante Richard Phillipps by lease and doe amerce him for the same in six shillings and eight pence.
Item We doe present the said Richard Grunow for carryinge of the furs alias gorss from of the said common for which we amerce him in three shillings and four pence.

Presentment of the jury.
Know all men by these presents that I Thomas Delahay of the Urishay in the parish of Peterchurch in the county of Hereford esq. lord of the several manors of Urishay Wilbrook, Trenant & Clothie Hopkin – in the said county of Hereford have made deputed and appointed and by these presents do make depute and appoint William Allen of the city of Hereford gentleman my true and lawful steward of and for my several manors aforesaid to hold and keep al and singular court leets, views of frankpledge, courts baron, hundred courts and all and singular other courts that have been udsuallyheld by the steward of the said manors or either of them . And do hereby as far as I have power give and grant unto him the said William Allen full powewr and authority for me and in my name or in his own name to sit as a bencher or suitor of the county court or Sheriff’s Court held at Hereford in and for the said county & to receive and take to his own use all such lawfull and reasonable fees and perquisites as belong to the office of bencher or suitor of the said court. And finally to act & do all such other matters and things that to the office of steward of the said several manors aforesaid or either of them or to the said office of bencher or suitor of the county court aforesaid belong or appertain during my will and pleasure. And I hereby ratify and confirm all and whatsoever the said William Allen shall do or cause to be done in the premises by virtue of these presents. Mr Harris is very particularly engaged & will be for the week; he therefore requests me to write. The cause came on this morning & I am happy to state that a verdict was given in your favour for one of the cottages 7 land adjoining (vizt. that occupied by James Parry) The defendants produced a lease of the other cottage & land dated 17 March 1743 – granted by John Delahay to Blanche & Elizabeth Watkins for 99 years from 25 March, 1743 at 11s rent. – They brought evidence to prove that it was the cottage occupied by John Hughes (the undertenant of Hughes the claimant) – and the court was of the opinion that it was sufficient proof that such cottage was still under lease; - the term expires 25 March 1842, being 19 years to come. – The lease described it as a cottage barn & land adjoining Urish Hay common. As we succeeded for the other cottage, it sub[ject?] Hughes to the payment of your costs. –

Also they present Richard ap Morgan in 4d , Thomas ap Ivor in 4d , John Turnor in 4d , Katherine ap Phelip in 2d for carrying away firewood out of the lord’s wood to his great damage therefore they are in his mercy .Also they present Richard ap Morgan in 6d , Thomas ap Ivor in 4d , Katherine ap Phelip in 4d for keeping goats there to the hurt and damage of their neighbours who are therefore in the lord’s mercy and they are ordered to put away their said goats by Candlemas next under the penalty of 7s .

A court of Elizabeth Delahay there held the day and year above said which is referred to the paper mark’d (4) as above.
To this court John Body came here in full court and took of the said Lady one messuage and garden with the appurtenances in Peterchurch which lately John Braimdon there held to whom the said Lady granted the aforesaid messuage and garden with the appurtenances To Hold to the said John Body and his, according to the custome of the manor for the term of .101. years yielding therefore yearly four shillings at the usual times to be paid by equal portions suit of court and all other services therefore formerly due and accustomed And gives to the said Lady for a fine for his entrance – therein to be had One pottle of wine And made his fealty to the said Lady.

These are in his majestie’s name towill and require you forthwith to give one and lawful summons to all and singular the inhabitants tenants and resiants within the said manour that they and every of them be and personally appear before me at the dwelling house of Thomas Draper in the parish of Peterchurch within the said mannour upon Thursday the fourth day of October next by ten of the clock in the morning at the court Leet of our sovereign lord the king and view of Frank pledge and also the court baron of Magdalen Delahay widow Lady of the said manour then and there to do their suit . Imprimis We the said jurors do present the death of Thomas Perkins happening to be murdered by an unlucky accident and by the report of the said Thomas Perkins before his expiration,he was murdered by the horn of a cow.
Also we present the smith’s forge within the mannor of Magdalen Delahay widow now in the possession John Draper being a cottage built partly upon the highway and partly upon the lady’s wast it being a cottage lately burnt and having don a considerable damage to the said lady in setting afire her barns And whereas the said John Draper rebuilds the said shop without the ladys consent upon her said wast . Therefore we fine the said John Draper in one pound for the rebuilding therefore and in ten shillings every month for the continuance thereof.
Also we present the several persons hereunder named being tenants within the said mannor and having been duely summoned to this court and not appearing (vizt.) George Parry, Lewis Powell, Sylvanus Lloyd, William Hall, John Draper, William Hancocks, John Gwyn, Charles Watkins and Thomas Jones and we amerce them to 2s each.

First we present that George Parry , Lewis Powell, John Draper Blacksmith & John Probert tenants of this mannor who owe suit & service to this court & have been severally duly summoned in person to appear at this court as appears by the oath of the bayleif of this mannor. Also we present John Draper of the parish of Peterchurch blacksmith for erecting a smith’s shop within this mannor made with stone timber & tyle upon the common king’s highway in the said parish of Peterchurch leading from the town of Ross in this county to the town of the Hay & in the county of Brecon within six months last past & for continuing the same to this time to the common nuisance of his majesties subjects passing that way & we lay a penalty of xxxixs upon the said John Draper to be levied upon his goods & chattels in case he does not remove the same in one month after notice hereof. And that William Roberts certifies the observance thereof at the next court under like penalty.

We present George Parry, Lewis Powell, William Hall, John Draper, [ ] , Roger Jones, William Probert & John Morgan, who owe suit and service to this court and have been duly summoned to appear at this court as appears by the oath of the bayleif of this mannor. But have made default and for such this default.
We amercethem each in the sum of three shillings and four pence. Affeared to two shillings a piece as to Powell, Pary,Hall & Draper & two pence each the rest.
Also We present a bridge called the Horse Pool Bridge lying across the river Doier upon the highway leading from Hereford to the Urishay to be dangerous to passengers and a cmon nuisance & that the inhabitants of the parish of Peterchurch ought & used to repair the same.
We also present that a common foot bridge or foot passage over the Old Brook between the township of Hinton & Peterchurch within this mannor leading from Hinton to Wilmerston is in decay and out of repair and that the same ought to be repaired by the inhabitants of Peterchurch aforesaid, And we lay a pain of thirty nine shillings on William Roberts and Thomas Fletcher surveyors of the highways that they repair the same on or before the 25th day of December next. And that Daniel Bird certifies the performance thereof at the next court on like penalty.

Imprimis We the jurors sworn & impannelled to enquire for our sovereign Lord the king and the lord of the mannor do present as followeth.
We present William Hall, John Draper [^John Draper ap & fined spared], Leonard Gundy, Philip Morgan, James Legg, John Lovell, John Gwynn, John [ ] , Charles Watkins, James Pritchard, John Probert, Jenkin Williams , John Jones who owe suit and service to this court And made default in appearing. And we do amerce each of them in the sum of two shillings for such their default, but on John Drapers appearing his fine was spared.
We have not anything to present . We present that John Draper of Peterchurch one of the tenants of this mannor hath lately incroached upon the lord’s wast next adjoining to the church yard of Peterchurch by building of a smith’s shop and a shed building adjoining unto it.
We the jurors aforesaid have not any thing more to present at this time.

Item We also present that a common foot passage over ther Old Brook between the township of Hinton & Peterchurch within this mannor leading from Hinton to Wilmeston is in decay & dangerous to passengers, and ought to be repaired by the Revd Mr William Seward Mr Walter Delahay & Mr Henry Llanwarn ,and we do lay a pain of thirty nine shillings on each of them the said William Seward, Walter Delahay & Henry Llanwarn, that they repair the same on or before the 25th day of December next, And that John Beavan & Henry Prosser or one of them certify at next court under the like penalty.

These are in his majesty’s name to will and require you forthwith to give due and lawful summons to all and singular the tenants inhabitants and residents within the said manor that they and every of them be and personally appear before me at the dwelling house of John Boswell known by the name of the Crossway within the manor aforesaid being the place accustomed for keeping court within the manor on Tuesday the third day of December next by 12 of the clock at noon of the same day at the court Leet of our sovereign lord the king and view of Frankpledge and also the court baron of the said Thomas Delahay lord of the said manors then and there to do suit and service and you are likewise required to give due and lawful summons to twenty four able freeholder that are tenents within the said manors that they and every of them be and personally appear before me at the time and place aforesaid at the said court to be sworn and impanelled to inquire for our sovereign lord the king and the lord of the said manors of all such matters and things as shall be given them in charge and have you then and there the names of the said tenants inhabitants residents and jurors and this precept Given under my hand and seal this nineteenth day of November, One thousand eight hundred and thirty three.
